Terms & Conditions
PROCEDURE: The property will be offered in 105 individual tracts, any combination of tracts, and as a
total unit. There will be open bidding on all tracts and combinations during the auction. Bids on tracts,
tract combinations, and the total property may compete.
DOWN PAYMENT: 10% down payment on the day of auction with the balance at closing. The down
payment may be made in the form of cash, personal check with bank letter, cashiers check, or certified
check. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, so be sure you have arranged financing, if
needed, and are capable of paying cash at closing.
APPROVAL OF BID PRICES: All successful Bidders will be required to enter into purchase agreements at
the auction site immediately following the close of the auction. All final bid prices are subject to the Seller’s
acceptance or rejection.
DEED: Seller shall provide a Limited Warranty Deed.
EVIDENCE OF TITLE: The Seller agrees to furnish Bidders preliminary title insurance commitment to
review prior to Auction. The cost of title insurance, if the Buyer(s) elect to have the title commitment executed,
will be the responsibility of the Buyer(s). Seller agrees to provide merchantable title to the property
subject to matters of record, general conditions of title, and similar related matters. All tracts sold “AS IS”.
REAL ESTATE TAXES: Taxes for 2010 will be prorated between Seller and Buyer at closing.
BUYER’S PREMIUM: A 10% Buyer’s Premium will be added to the final bid price and included in the total
purchase contract.
CLOSING: Closing shall take place 30 to 45 days after auction, or as soon thereafter as applicable closing
documents are completed.
POSSESSION: Possession of the property shall be given immediately upon closing.
SURVEY: A new survey will be available for each tract in the auction. Actual survey expense will be the
responsibility of the Buyer. The buyer will be assessed $30 per acre for surveying and an additional linear foot fee for the surveying of interior lines between auction tracts. A schedule of line distance and cost is found below.

PROPERTY INSPECTION: Each potential Bidder is responsible for conducting at their own risk, their own
independent inspections, investigations, inquires, and due diligence concerning the property before the
auction. Inspection dates have been scheduled and will be staffed with auction personnel. Please feel free
to inspect at any other time.
AGENCY: Schrader Real Estate and Auction and Woltz & Associates, Inc. and their representatives are
Exclusive Agents of the Seller.
